As a state agency, Texas Health and Human Services has a duty to provide the public with information about its operations. However, state law provides that any records compiled by the Office of Inspector General in connection with an investigation or audit are confidential and not subject to disclosure under the Texas Public Information Act.
All information and materials subpoenaed or compiled by the office in connection with an audit or investigation are confidential and not subject to disclosure under Chapter 552 of the Texas Government Code, and not subject to disclosure, discovery, subpoena, or other means of legal compulsion for their release to anyone other than the office or its employees or agents involved in the audit or investigation conducted by the office, except that this information may be disclosed to the Office of the Attorney General, the State Auditor's Office, and law enforcement agencies.
As a result, we are unable to provide a status update on any fraud referrals, including those referrals you have made to us.
However, the Office of Inspector General is required to prepare a final report on each audit or investigation we conduct. These reports include a summary of the activities performed by our office, a statement regarding whether the audit or investigation resulted in a finding of wrongdoing, and a description of any findings of wrongdoing. These reports are subject to disclosure under the Texas Public Information Act.
All requests for information must be in writing. Requests made by telephone are not considered open records requests.
